These Terms and Conditions ("Terms") govern your access to and use of propertyzone.ie and related Property Zone Ireland services ("Property Zone", "we", "us" or "our"). By using the website, creating an account, submitting an enquiry, publishing a listing, using account tools or purchasing a paid listing service, you agree to these Terms.

1. About Property Zone

Property Zone is an online property platform that helps users search for property, publish listings, contact listing owners or agents, request viewings, save searches, create shortlists, compare properties and use buyer decision tools.

We are not an estate agent, letting agent, auctioneer, solicitor, mortgage broker, surveyor, financial adviser or party to any property sale, letting, mortgage, valuation or professional-services transaction unless we state otherwise in writing. Property transactions and related professional services are arranged directly between users and relevant third parties.

2. Who May Use the Service

• You must be at least 18 years old to create an account, submit a listing, request a viewing or use paid services.
• You must provide accurate account, contact, billing and listing information and keep it up to date.
• You are responsible for activity on your account and must keep login credentials secure.
• Agents, agencies, landlords and other advertisers must have the authority required to advertise the relevant property and respond to enquiries.

3. Accounts and Account Tools

Account features may include favourites, saved searches, alerts, shortlists, affordability profiles, commute points, viewing dashboards, listing management, payment history, lead dashboards, agency tools, agent-client workspaces and notifications.

We may suspend, restrict or close an account where we reasonably believe it has been used for fraud, spam, unlawful activity, misleading listings, abusive behaviour, security abuse, non-payment or breach of these Terms.

4. Property Listings

If you submit or manage a listing, you confirm that:

• you have the legal right, owner instruction, landlord instruction, agency mandate or other authority needed to advertise the property;
• the listing is accurate, current, not misleading and compliant with applicable Irish law and advertising standards;
• prices, availability, location, BER information, property type, photos, floor plans, videos and descriptions are honest and kept up to date;
• you have the rights needed to upload and publish all text, images, video links, documents and other content in the listing;
• you will not advertise properties that are fake, unavailable, duplicated in a misleading way, discriminatory, offensive, unsafe or intended to harvest money or personal data unlawfully; and
• you will respond to enquiries and viewing requests professionally and within a reasonable time.

How listings are ordered in search results

The main parameters that decide the order of listings in search results, in order of weight, are:

• Paid promotion. Listings with an active paid “Top of Category” promotion are shown first, whichever sort order is chosen, and are always labelled “Featured”.
• Private sellers. On the default sort (“Most Popular”), listings by private sellers come before agency listings within each of the groups above. On any other sort, this only decides between listings that are otherwise equal.
• The sort order you choose. “Most Popular” (the default) orders by the number of views the listing has had; the other options order by date listed, date last updated, price, or price per square metre. On price sorts, listings with the price on application come last.

No other payment or relationship with an advertiser affects the order. Listing packages and agency subscriptions decide whether and for how long a listing is shown, not where it appears.

5. Agents, Agencies and Licensing

Property service providers operating in Ireland may be required to hold the appropriate Property Services Regulatory Authority (PSRA) licence. If you use Property Zone as an estate agent, letting agent, auctioneer or property management agent, you are responsible for holding and maintaining any licence, authorisation, insurance, client-account arrangement and professional standard required for your activities.

Verification badges and quality signals help users assess listings and providers, but they are not guarantees that a transaction is risk-free. Users should independently verify PSRA licence details, ownership, identity, BER details, contracts and payment instructions before committing to a transaction.

6. Fees, Paid Listings and Billing

Some features may be free and others may require payment — for example a one-off listing fee for private sellers or a monthly subscription plan for agencies. The price, billing model and main conditions should be shown before you purchase or activate a paid service.

• You authorise us and our payment providers to process payments you approve.
• Payment and billing transactions are recorded as a platform ledger for listing services and related charges.
• You are responsible for ensuring that your billing details are accurate and that you have authority to use the payment method.
• Except under your right to cancel as a consumer (section 7) or where applicable law says otherwise, fees for active paid listing services are non-refundable once the service has begun or the paid placement has been supplied.
• Where Irish or EU consumer law gives you mandatory rights, nothing in these Terms limits those rights.

7. Consumer Rights and Cancellation

If you are a consumer purchasing a paid digital or online service from us, Irish and EU consumer law may give you pre-contract information rights, cancellation rights and other mandatory protections.

Your right to cancel a paid listing. If you buy a listing package as a consumer (a private seller or landlord, not a business), you may cancel the contract within 14 days of the day you paid, without giving a reason.

• Starting straight away. Before payment we ask you to request that your listing start immediately, inside those 14 days. If you then cancel within the 14 days, we refund what you paid minus an amount in proportion to the days your listing was available on the site. Days spent waiting for moderation before it went live are not charged.
• When the right ends. You lose the right to cancel once the service has been fully provided, which you acknowledge when you make that request.
• How to cancel. Tell us clearly within the 14 days, by email to [email protected] or by replying to your invoice email. You may use the model form below, but you do not have to. It is enough to send your message before the 14 days run out.
• Refund. We refund within 14 days of receiving your cancellation, to the payment method you used, and take the listing down.

Agency subscriptions are business contracts; the consumer cancellation right does not apply to them. They can be cancelled at any time from the agency dashboard, effective at the end of the billing period.

These Terms do not exclude or restrict rights that cannot legally be excluded, including rights relating to unfair terms, misleading commercial practices or statutory consumer remedies.

8. Buyer and Renter Tools

Search filters, affordability labels, buyer-fit signals, commute estimates, market intelligence, BER/heating insights, freshness indicators, response-time badges, comparison tools and next-step prompts are provided for information and convenience only.

They are not legal, financial, mortgage, valuation, surveying, tax, insurance, planning, engineering or investment advice. You should obtain appropriate independent professional advice before making an offer, signing a lease or contract, paying a deposit, arranging finance or relying on a property decision.

9. Enquiries, Viewings, Shortlists and Collaboration

• When you submit an enquiry or viewing request, we may forward the relevant details to the listing owner, agent or agency.
• Viewing slots are requests until confirmed by the responsible agent or listing owner.
• Shortlists may be private, shared through a link or curated by an agent for a buyer. Users who can access a shortlist may see ratings, stages, comments and related activity.
• You must not use contact, viewing or shortlist features to harass, spam, impersonate, scrape data, bypass safety rules or send unlawful content.

10. User Content and Licence to Use It

You retain ownership of content you submit, such as listing text, photos, videos, comments, reports and messages. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt for formatting, distribute and use that content as needed to operate, promote, moderate and improve the service.

You must not upload content that infringes intellectual property rights, breaches privacy, is defamatory, discriminatory, obscene, fraudulent, misleading, malicious, unlawful or harmful to the security of the platform.

11. Moderation, Trust and Safety

We may review, edit, reject, suspend or remove listings, profiles, comments, messages or accounts where we reasonably believe they breach these Terms, create legal risk, harm users, mislead the market, contain prohibited content or undermine trust in the platform.

Reports submitted through listing-report or Trust & Safety tools may be reviewed automatically and manually. We may contact the relevant advertiser, restrict listings, remove verification badges, preserve evidence, or report serious suspected fraud or abuse to appropriate authorities.

12. Prohibited Use

• Do not submit fake listings, bait listings, duplicate scams, false prices or misleading availability.
• Do not ask users to pay deposits or fees before proper identity, authority and viewing checks.
• Do not scrape, crawl, copy or republish substantial parts of the site without permission.
• Do not interfere with security, rate limits, APIs, authentication, forms or infrastructure.
• Do not use the site to send malware, spam, phishing, discriminatory content, harassment or unlawful communications.
• Do not impersonate another person, agency, landlord, buyer, regulator or Property Zone representative.

13. Third-Party Services and Links

The site may link to or embed third-party services such as maps, video providers, payment providers, official property registers, partner service providers or external agency websites. We are not responsible for third-party content, availability, terms, privacy practices, advice or services. You should review the relevant third-party terms before relying on them.

14. Availability and Changes to the Service

We aim to keep Property Zone available and useful, but we do not guarantee uninterrupted, error-free or permanent availability. We may change, suspend, withdraw or limit features, categories, account tools, pricing, ranking logic, moderation rules or integrations where needed for product, security, legal or operational reasons.

15. Disclaimers

Property listings and user-submitted content are provided by third parties or users. We do not independently verify every fact, legal title, ownership, planning status, BER number, licence number, property condition, price, availability, measurement, service charge, tax position or contract term.

To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.

16. Limitation of Liability

To the fullest extent permitted by Irish law, we are not liable for indirect, consequential, special or punitive loss, loss of profit, loss of opportunity, loss of data, loss arising from property transactions between users, or losses caused by third-party listings, third-party providers or user conduct. Where we are liable, our liability will be limited to the amount you paid us for the relevant service giving rise to the claim, unless a higher amount is required by law.

17. Indemnity for Business Users and Advertisers

If you use Property Zone as a business, advertiser, agent, agency, landlord or professional service provider, you agree to indemnify us against losses, claims, costs and expenses arising from your listings, content, breach of these Terms, breach of law, infringement of rights, misleading information, failure to hold required authority or licence, or interactions with users outside the platform.

18. Privacy

Our Privacy Policy and Cookie Policy explain how we process personal data and use cookies or similar technologies. By using the service, you acknowledge those documents.

19. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date shows when this page was most recently changed. If a change is material, we may provide additional notice where appropriate. Continued use of the service after changes take effect means you accept the updated Terms.

20. Governing Law and Courts

These Terms are governed by the laws of Ireland. Subject to any mandatory consumer rights that allow you to bring claims elsewhere, disputes relating to these Terms or the service will be subject to the courts of Ireland.
